eCollect AG as a collection service provider acts as a controller within the meaning of Art. 5 letter j FADP and is entitled to process your personal data for the purpose of contract performance and debt collection resp. legal enforcement as well as within the scope of its own receivables management.
If personal data is not collected from you as data subject, we are also obliged to inform you about the processing of your data by our company in accordance with the requirements of Art. 19 FADP.

Dear ladies and gentlemen,
By contacting you for the first time by post and/ or e-mail, we would like to inform you below about the processing of your data by eCollect AG in accordance with Art. 19 FADP.
Purposes of processing
The data processing by eCollect AG is justified according to Art. 30 in conjunction with Art. 31 para. 1 and 2 letter a FADP. On the one hand, the processing is carried out for the fulfilment resp. performance of a contract, an element of which is the payment obligation. On the other hand, the processing of personal data is legitimised by the overriding private interest of the creditor and our overriding interest as a collection company in the implementation of collection measures as a generally recognised service for the protection and upkeep of a well functioning economy.
Data categories and source
We process the following categories of data: master data, communication data, contract data, receivables data, payment information, if applicable. The data from the above-mentioned data categories was transmitted to us by our client.
Sensitive personal data within the meaning of Art. 5 letter c FADP are not processed by us.
No profiling is performed by us within the meaning of Art. 5 letter f FADP.
Categories of recipients
Within the scope of the collection procedure, your data will be transferred to our client and, if applicable, to the following categories of recipients, insofar as this is necessary for the collection of the claim or if overriding legal regulations or permission rates are applicable: representatives of the data subject, assignees, service providers, lawyers, courts, investigating authorities, tax authorities.
Data storage duration
After payment of the outstanding claims or termination of the respective collection procedure for other reasons, the data is usually kept in our system for three years.
After this three year period expires, we will check whether we still need your data and whether statutory storage obligations prevent deletion.
Rights of the data subject
Pursuant to Art. 25 FADP, every person may request information from the controller on whether personal data about him or her is being processed.
If the legal requirements are met, every data subject has the right under Art. 32 FADP for the protection of their personal data against unlawful processing to request the correction of incorrect personal data, the prohibition of specific data processing, the destruction or deletion of the data or the prohibition of specific disclosure to third parties.
